The window for cannabis microbusiness applications is slated to open in February 2027. The Virginia Cannabis Control Agency  (CCA) has not yet disclosed the exact application requirements (as of late August 2026), but the statute requires the use of a lottery qualification process similar to the licensing systems recently employed in Kentucky, Minnesota, Maryland and Delaware. The process has been confusing in VA due to disagreements between the legislature and the governor, and how many of the rules are written into the law, with many yet to be determined.

Here’s what we know:

The law mandates that at least 100 microbusiness licenses must be issued first. Other than that, the law limits retail licenses to 350 and the largest cultivation license type (Tier V) to a maximum of 5 licenses until 2028. That means we don’t yet know if the regulatory agency is going to start by issuing the bare minimum of 100 smaller licenses (mostly microbusinesses), or allow many more.

Technically they can put off finalizing regulations, and if that happens later than licensing, it makes the licensing process simpler because applicant don’t need to refer to the VA cannabis regulations in the paperwork they submit. We saw a similar phenomenon in the Kentucky lottery and licensing process in 2024 and in Minnesota in 2025.

Understanding the VA Cannabis Application Process

We know that certain documents will need to be submitted to qualify for a cannabis licensing lottery in VA, but we don’t yet know what they are. We could find out next week, next month, or only a few weeks before the submission window opens, so we have to stay on our toes for upcoming announcements coming from VA!

We know a few things now that are helpful for prospective applicants:

  • You do not need to be a resident of Virginia to apply
  • You do not need to already have property secured to apply
  • The microbusiness license type is an attractive small business type because it allows for small scale vertical integration (you can grow, manufacture and sell retail), yet it’s big enough to still make great money (read more about the Virginia cannabis microbusiness license here)
  • With 100 microbusiness licenses available, winning a lottery will have pretty good odds. We expect somewhere between 3500-5000 applicants.

  • The microbusiness applicants must fall into 1 of 3 categories– 1) hemp license holder prior to January 1st 2021, 2) social equity (impact) applicant, or 3) USDA farmer. Read About VA Cannabis Social Equity Qualifications Here.
  • There MAY be many more licenses granted of all types, but it’s not mandated by the statute and we don’t yet know when that will be or if the process for obtaining them will have the same requirements.
  • If you are an impact applicant, and if you win a license and complete the process of getting it fully approved, you cannot sell or transfer more than 49% of the business entity for a 5-year period. This is designed to keep people from applying solely for the opportunity to flip the license for a profit.
  • If you are a general applicant, you can sell or transfer your license as soon as it’s built out and the license is finalized.

Do I Need An Attorney to Help me Obtain a Virginia Cannabis License?

No, you won’t need an attorney unless you have a non-standard situation that needs special handling. We have seen applicants in other states pay attorneys 5x more than what we charge for doing work that’s as good or better. Many attorneys are compliance experts, but they aren’t cannabis experts, and in fact, about 15% of our customers ARE attorneys who are looking for shortcuts to help them provide for their clients. The big reason why attorneys aren’t critical for the states that have recently issued cannabis licenses is because states have normalized what’s called a “cure period” as part of their application acceptance process. That means they applicants a chance to fix any aspect of the application that’s deemed “deficient” by the VCCA.

If we write your documents for you, we include a guarantee to cure all application deficiencies as part of your flat-rate payment to us. We have a record of 100% success in qualifying applicants for state cannabis license lotteries.

How Much Does it Cost to Get Help with my VA Cannabis Application?

We charge a flat rate of $4500 for lottery qualification paperwork, including corrections–the lowest cost in the industry. We’ve been doing this for long enough now that we have a streamlined process that draws on our knowledge and written materials from the other states we’ve worked in over the past decade.
